Terms Of Service EasyManage.com (also referred as "we", "our", "us", "EasyManage", "EASYMANAGE", "Company" in this document), is privately owned, and offers software and services which include EasyManage.com website (the "EasyManage.com Website", also referred as the "Site") and any other content, features, or applications offered by us from time to time (collectively referred as the "Service"), subject to following Terms of Service: ACCEPTANCE OF TERMS This Terms of Service sets forth legally binding terms for your use of EasyManage products and services. By using EasyManage products or services, you agree to be bound by the terms of this agreement, whether you are visitor or registered member to the Site or using our software (either on the Site or elsewhere.) You may not use the Site and Service and may not accept the Terms if you are not of legal age to form a binding contract with EasyManage, or you are a person prohibited from accessing or receiving the Service under the laws of USA or other countries including your resident country. PROVISION OF THE SOFTWARE LICENSE AND SERVICE We reserve the right to grant or not to grant the software license and service to a prospective user or customer subject to all information supplied being correct. The Software products and Services are supplied for lawful purpose only and without any express or implied warranties save for those warranties implied or imposed by which cannot be excluded or restricted under USA Law. Customer acknowledges, accepts and specifically declares that he is fully aware of the nature and terms of service. The customer shall be exclusively responsible for making arrangements for getting the necessary hardware and software at his end. It is explicitly agreed that EasyManage does not undertake any responsibility with regard to procuring / installing / maintaining the hardware and / or software at the customer's end. In order to use the Service, you will need to get access to internet and have device to connect which are totally users responsibilities. You will need to pay any service fees associated with such access to the Service in accordance with the applicable payment terms. EasyManage makes no guarantee that Site and Service will be continuously available without any interrputions. Beta releases: The products and services made available as Beta are not permitted for use for any commercial or production purposes. In Beta releases, and during promotions, EasyManage makes some premium features available for free for some duration, which will be mentioned on Site. For such premium features, charges may be introduced later on. Users will be notified at the time of implementing any charges for the same. Some of the Services are premium requiring payment of fees and charges and these fees and payment terms are subject to change from time to time. The revisions to terms will be posted on this website and communicated to existing users of the service via email. When referred as "Content", it means any work of authorship in Service, including, comments, recommendations,photos, videos, music,logos, trademarks, postings, messages, forums, sounds, images, text, files, listings, tags and other content added to or submitted on Service. EasyManage makes no guarantee that Your Content will be safely stored and backed up on the Site. All Users should keep back-up of their Content themselves. "EasyManage User" means person who Signs-Up for "EasyManage ID" and then he can further sign-up for Featured Services and access available free or premium services. "EasyManage ID" is a unique identifier assigned to users on Sign-Up. The "EasyManage ID" selection by user should be appropriate for his or her purpose of Site use. "EasyManage ID" is subject to restrictions and reserved words and we reserve the right to dis-allow and or rename "EasyManage ID" even after it is assigned and in use. Email address verification: EasyManage verifies the email address submitted by users at the time of sign-up for it's validity. If email is invalid, the user account is disabled and removed. Service - Acceptable Use and Conduct You are solely responsible for your Content and conduct. You will not use Service for unlawful or harmful purposes. You agree to following: You will not upload any Content, communicate with other users or use Service: - In a manner that violates and infringes any third party's intellectual property rights, other proprietary rights or contractual rights; - in a manner that Content contains software viruses or is destructive or limiting nature to Service. - to start, involve or engage in chain letters, spamming, pyramid schemes, illegal type of advertisements and those not confined to any applicable laws and regulations; - in a manner that is fraudulent or illegal; - in a manner that is stalking, defamatory, attacking, threatening, abusive, violent, harassing, malicious, libelous or any harmful way to any person or entity, or invading another's privacy; - in a manner that is harmful to minors in any of the way; - in a manner that is hateful or discriminatory based on race, color, sex, religion, nationality, ethnic or national origin, marital status, disability, sexual orientation or age or is otherwise objectionable, as reasonably determined by us; - to impersonate an EasyManage employee, or any other person; - to interfere with an excessive number of posting of messages causing flooding to Service; - in a manner that promotes unlawful distribution of copyrighted content; - in a manner that gives personal or identifying information about another person without that person's explicit consent; - in a manner that is includes solicitation or advertising; - to use or disclose data, including personal information, about other Users without their consent; You agree to not post on the Service or provide to other Users any information or content that is of following nature: - any content (including images, photographs) that is obscene, has nudity, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Regarding Any personal information of following nature, You are responsible yourself, if you are posting on the Service or provide to other Users: - telephone and fax numbers, street addresses and personal confidential information Despite this prohibition, the information posted by or provided by other Users of the Service may contain inappropriate, offensive or objectionable material, products or services, and we assume no responsibility or liability for such material. THIRD PARTY SOFTWARE All third party software, that may be required to use our products is included for use at the customer's option or should be bought by customer's directly. We will not be responsible for any losses or damages which may occur resulting from the use of any third party software. Any support that is needed has to be availed from the respective companies. REVISIONS TO TERMS OF SERVICE We reserve the right to revise these terms of service from time to time without notice to you, the revised terms will take effect immediately after they are posted on this page. User Disputes You are solely responsible for your exchange of information and interactions with other Site Users. We reserve the right, but are not obligated, to monitor disputes between you and other Users. In the event of such issue becoming a dispute, You and EasyManage both agree to resolve Disputes only by arbitration or in small claims court (for qualifying claims). The parties expressly agree that they are waiving their right to sue in court and that arbitration is the parties sole remedy to resolve disputes. Your use of this site and software product signifies your agreement to the terms and conditions of our Licence Agreement and this "Terms of Service".
